SUBJECT AND SCOPE OF THE SERVICE:

LEARNMASTER.ORG is a digital platform (“the Site”) dedicated to providing registered internet users (“Customers”) with a service to purchase and download E-Learning materials.

Customers have the option to choose an E-Learning material from the Site, download it, and install it on their personal computers for permanent use (“the Service”).

LearnMaster.org is operated by FRAG TECHNOLOGIES LTD, a private limited company registered in the United Kingdom (Company No. 15452967), with its registered office at 124 City Road, London, EC1V 2NX, United Kingdom. The use of this website and any related services shall be governed by and construed in accordance with the laws of the United Kingdom.

The core offering of the Service is the electronic distribution of E-Learning materials along with all necessary components for their installation and usage, such as serial numbers, activation keys, bonus content, etc. These are provided as digital files. It is important to note that no physical copies, such as CDs or DVDs, will be provided (“E-courses, E- training, …”).

Additionally, the Service extends to include other digital products like bundles, tools and other. The same Terms and Conditions described here are uniformly applicable to these additional products

REQUIREMENTS FOR SERVICE USE:

Internet Connectivity: The digital size of the E-Learning materials available for download varies significantly, often ranging from several megabytes to extensive gigabytes. Therefore, it is strongly advised that Customers possess a high-speed internet connection, such as ADSL or cable, to facilitate efficient downloading. Continuous internet access is also essential for installing and initiating the downloaded E-Learning material, and in some cases, to access specific features like online tests.

Account Creation: To access and use the Service, Customers are to set up an account. This process requires providing accurate information, including a valid email address. Providing incorrect or incomplete information may lead to the inability to process your order or access the Service.

System Requirements: The E-Learning materials demand specific system capabilities (e.g., CPU power, RAM, GPU) to function optimally. These system requirements vary for each E-Learning material and are explicitly listed on the Site. Customers are responsible for ensuring their computer system meets these minimum requirements. In cases of uncertainty regarding system compatibility, Customers should consult Customer Service for guidance and clarification.

The Company assumes no responsibility for any misuse of the downloaded E-Learning materials or for their compatibility issues with the Customer’s computer system. It is the Customer’s obligation to ensure compliance with the stated requirements and to use the E-Learning materials as intended.

UPDATE TO THE TERMS

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

CUSTOMER’S RIGHTS AND RESPONSIBILITIES:

CUSTOMER ACCOUNTABILITY:

The Customer bears full responsibility for safeguarding the confidentiality of their account’s login credentials, including the password. They are solely accountable for all activities conducted under their account.

THE COMPANY’S AUTHORITY:

The Company reserves the authority to suspend or terminate any account that is suspected or found to be engaged in activities that violate any terms of these Terms & Conditions. This includes, but is not limited to, the provision of false registration information or any form of misuse related to the Site. Individuals owning such suspended or terminated accounts are prohibited from re-registering on the Site without express permission from the Company.

REPORTING OBLIGATIONS:

In instances of unauthorized account access or other security breaches, it is obligatory upon the Customer to promptly inform the Company by reaching out to customer services. Prompt reporting can help in mitigating unauthorized access and securing the account.

CAUTION AGAINST PHISHING:

The Company emphasizes that it will never request Customers to disclose their passwords. Any such requests should be considered as potential phishing attempts, which are illegal endeavours to acquire sensitive information such as usernames, passwords, and credit card details. Customers should remain vigilant and report any such suspicious requests to the Company immediately, as these could indicate fraudulent activities by third parties.

PAYMENT POLICY

All payments are processed in EUR, our primary currency. We offer several convenient payment options for our clients, including credit or debit cards, Google Pay, and Apple Pay.

Please note that we do not charge any additional fees or commissions for using these payment methods. This means the amount you see in your cart is the exact amount you will pay—your selected payment method will not affect the final price. We ensure secure processing of all transactions in compliance with industry standards to protect your data.

DELIVERY OF PRODUCT

Upon successful payment verification, the Customer gains access to the content required for installation of the E-Learning materials. This includes, but is not limited to, serial numbers, activation keys, and any bonus or test content. To safeguard against fraudulent transactions, the Company reserves the right to withhold or delay the delivery of these components if the payment does not successfully undergo validation. In circumstances where a Customer experiences a delay in receiving their E-Learning materials, they are encouraged to proactively reach out to customer service. This action may expedite the process of payment validation, thereby facilitating quicker access to the E-Learning material and its associated contents. The Company is committed to ensuring a smooth delivery process while maintaining strong measures against fraud.

POLICY ON CANCELLATIONS AND REFUNDS:

Our refunds and cancellations policy is designed to be comprehensive and customer-focused. Refunds are considered under specific conditions as outlined below:

  1. A refund request must be made within 30 days of the purchase. 
  1. The Customer must not have shared, transmitted, or disclosed the E-Learning material serial numbers (including activation key, testing key, and bonus key) with any third parties.

The customer service team will exercise its discretion in assessing whether the Customer’s request meets these criteria. Each request will be evaluated individually, based on the specific circumstances presented.

Customers seeking a refund should reach out to Customer Service at info@learnmaster.org. The request should include the Customer’s full name, order number, a detailed description of the issue, and any pertinent evidence or documentation that supports the refund claim.

Our team may follow up for additional information or clarification as needed. Once a refund request is approved, we will promptly initiate the refund process.

Refunds will be processed using the same payment method employed for the original purchase. The amount refunded will reflect the original price paid, minus any applicable fees, if any.

We strive to process refunds promptly. The standard processing time is approximately 14 days. However, the visibility of the refunded amount in the Customer’s account is subject to the policies of the respective issuing bank, which may add additional time.

LICENSE OF USE:

Acquiring E-Learning material products from our site grants the Customer a personal, non-exclusive license for the usage material. This license is strictly for private, non-commercial purposes and is non-transferable. Customers are required to adhere to the End User License Agreement (EULA) set forth by the Material Publisher, which is provided during the E-Learning materials installation process and/or, depending on the E-Learning material, accessible on our Site.

RESTRICTIONS ON USE:

Under this license, the Customer is expressly prohibited from altering, decompiling, translating, adapting, or copying the downloaded E-Learning material(s) in any unauthorized manner. The only exception permitted is the creation of a backup copy onto a CD, DVD-ROM, or another form of personal storage media for archival purposes.

IMPACT OF UNAUTHORIZED DISTRIBUTION:

Distributing unauthorized copies of the any materials, whether over the internet or other networks, directly undermines the development and distribution of downloadable material and deprives the rights holders of the revenue necessary for creating new E-Learning content. To combat fraud and protect the rights of publishers, Customers may be limited to installing the materials on a specified number of devices and may be restricted in the number of times the E-Learning material can be reinstalled. Additionally, for certain materials, Customers might need to register an account on the Publisher’s or a designated third party’s website to access or launch specific E-Learning features.

ASSISTANCE WITH RE-INSTALLATION ISSUES:

Should Customers encounter issues with the reasonable re-installation of the material (due to loss, system alteration, etc.), they are encouraged to contact customer service. Our team will review any reasonable requests and may extend additional rights to the Customer, ensuring a fair and satisfactory resolution.

Our aim is to ensure that Customers enjoy their E-Learning materials while respecting the intellectual property rights of the developers and publishers. For any queries or concerns regarding the License of Use, Customers are advised to get in touch with our customer service team.

The purchase of gift vouchers, subscriptions, and gift cards is also governed by this license. These products are for personal use and cannot be resold or used for commercial purposes.

The purchase of these digital products confers to the Customer a right to use them exclusively for personal learning purposes.

Once purchased, these items must be tied to the Customer’s account or the account of the designated recipient in the case of a gift. They are not meant to be transferred between accounts or individuals beyond the initial gifting process.

Reselling or commercializing these products in any form is strictly prohibited. This includes any form of unauthorized distribution, whether for profit or otherwise.

It is the responsibility of the Customer to understand and comply with these terms. Any misuse can result in the suspension or termination of the Customer’s account.

CUSTOMER SUPPORT SERVICES:

Customers seeking support can first visit our online support FAQ page, which hosts information addressing common questions and issues.

If the solution to a problem is not found in the FAQs, Customers are encouraged to reach out to our customer service team through the contact form available on the Site.

EFFECTIVE COMMUNICATION FOR SUPPORT:

To enable our customer service team to efficiently address and resolve any issues, Customers are advised to provide detailed information relevant to their query. This includes the Order ID sent post-purchase and a clear description of the issue encountered.

It’s important to note that the Company’s responsibility is primarily related to the Service delivery. This includes aspects like the key activation process, installation assistance, and payment-related issues.

For problems specifically related to the product itself, such as content issues, bugs, or testing-related inquiries, the responsibility lies with the E-Learning material Publisher. Customers are advised to contact the Publisher directly for such issues.

GUARANTEES AND WARRANTIES:

SCOPE OF WARRANTIES FOR CONSUMERS:

Consumers are entitled to a limited warranty for each E-Learning material they purchase, as stipulated under the respective Publisher’s end-user license agreement. This warranty is aligned with the present Terms and Conditions.

The warranty essentially ensures that the E-Learning material functions as advertised and is free of significant defects that impede its normal operation.

In situations where the E-Learning materials is found to be defective, the Company’s liability and guarantees are confined to either replacing the defective E-Learning materials or providing a refund for it.

PRESERVATION OF CUSTOMER DATA:

The Company is committed to maintaining all data exchanged with Customers under secure and reasonable conditions. The data includes, but is not limited to, transaction records, communication logs, and account information. For the purpose of record-keeping, these data are stored on reliable and durable backup mediums. 

In the event of any discrepancies or conflicts between the parties, the data held by the Company and any other form of documentation will be considered the authoritative source.

GENERAL PROVISIONS 

The Company holds the authority to revise and update these Terms and Conditions at its discretion. This is a necessary practice to ensure that the terms stay current and effective, reflecting any legal, operational, or business changes.

Whenever updates are made, the new Terms and Conditions will be made accessible on the Site for review by all users.

Upon their publication on the Site, the updated Terms and Conditions become effective immediately. They will apply to all new transactions and interactions with the Site from that point forward.
